Acceptance of terms

By accessing or using Better Buy (“Service”), provided by Idiot Index, Inc. (“Company,” “we,” “our,” or “us”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must discontinue use of the Service immediately. These Terms constitute a legally binding agreement between you and Idiot Index, Inc.

Description of service

Better Buy is a browser extension that provides product recommendations, Better Buy Scores, alternative product suggestions, and affiliate links based on user interactions. The Service is intended for informational and commercial purposes only. Idiot Index, Inc. does not sell products directly and is not responsible for any transactions made through third-party retailers.

eligibility

To use the Service, you must be at least 18 years old or the legal age of majority in your jurisdiction. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Service on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

User Data & Privacy

Your Service use is subject to our Privacy Policy, which governs how we collect, use, and share data. By using Better Buy, you consent to data collection and use as our Privacy Policy outlines. We reserve the right to modify our data collection practices at any time, with or without notice, subject to applicable laws.

License & Restrictions

• Reverse engineer, modify, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Use the Service for unlawful purposes or in violation of any applicable laws or regulations.
• Attempt to bypass security measures, exploit vulnerabilities, or interfere with the Service’s operation.
Use automated systems, bots, or scraping tools to extract, copy, or harvest information from the Service. Violate third-party intellectual property rights through the use of Better Buy.
• Engage in any fraudulent activity, including generating false clicks, purchases, or interactions.
• Violation of these restrictions may result in immediate termination of your access to the Service and potential legal action.

Affiliate Links & Commissions

Better Buy partners with affiliate networks to earn commissions on purchases made through affiliate links. By clicking an affiliate link, you acknowledge that:

• We may earn a commission at no additional cost to you.
• Prices, availability, and offers displayed via the Service may change without notice.
• We do not guarantee the accuracy of pricing, discounts, or promotions presented through affiliate links.

Modifications & Discontinuation

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without liability. Continued use of the Service after changes to these Terms constitutes acceptance of the revised Terms.

Disclaimers & Limitation of Liability

a) No Warranty THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. IDIOT INDEX, INC. DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO GUARANTEES ABOUT THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE.

b) Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDIOT INDEX, INC. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED $50 USD.

Indemnification

You agree to indemnify, defend, and hold harmless Idiot Index, Inc., its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from:

• Your violation of these Terms.
• Your misuse of the Service.
• Any unauthorized access or security breach linked to your use of Better Buy.
• Any legal claims or disputes resulting from your interactions with third-party retailers through affiliate links.

Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved exclusively through binding arbitration in California, in accordance with the rules of the American Arbitration Association (AAA). Users waive their right to bring class-action lawsuits or participate in class-wide arbitration.

Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, if we determine that you have violated these Terms or engaged in fraudulent or harmful activities related to the Service.

Changes to Terms of Service

We may update these Terms at any time. We will notify users through email or an in-service notification if significant changes are made. Your continued use of Better Buy after modifications constitutes your acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be severed, and the remaining Terms shall remain in full force and effect.
